APOLLO GAS INC. COMPLAINT AGAINST ATCO GAS WITH RESPECT TO
TERMINATION OF BILLING
SERVICES
Dear Mr. Smith,
Having regard for the various submissions of Apollo and Atco, that the issues revolving around this complaint have to do with the ability of ABM’s (Agents, Brokers and Marketers) to penetrate the Alberta Market as stipulated in Board decision U96052. It is the position of various Aboriginal communities that any direction the Board would give in this case would make it clear that this does not apply to First Nations. Any arrangement for ABM’s to operate on First Nations lands would first have to be made by way of permit with Her Majesty the Queen in the Right of Canada and Her Minister in charge of Indian and Northern Affairs. Such a permit would have to be ratified by a band council resolution of the First Nation the ABM wished to do business on, around or with. The expectation then would be that until such a permit was in place ABM’s or their ilk would not be seeking to solicit business on band lands.
